This Privacy Policy is provided to you by OTHRSource, LLC (referred to as the “Company”, “we”, “our” or “us”). A user of the OTHRSource Platform (the “Platform”) is hereinafter referred to as a “User” or “Merchandiser”, or "Brand Helper" or collectively, the “Users”. In this Privacy Policy, “you” and “your” refer to an individual User of the Platform.

This Privacy Policy describes what information we collect and how we use that information. If you have questions about this Privacy Policy, please email as us at support@othrsource.com. When we refer to “Contact Information” we mean information like your name, address, telephone number and e-mail address. “Personal Information” refers to personally identifiable information about you and transactions in your OTHRSource account, including information about your transactions.

By using the OTHRSource Platform, you do hereby warrant and represent that you have read, understand and agree to all terms and conditions stated herein, and our Terms of Service, currently available at http://www.othrsource.com/terms (the “Terms of Service”). This Privacy Policy is incorporated into, and considered a part of, the Terms of Service, and any terms not defined herein have the meanings ascribed to them in the Terms of Service. This Privacy Policy and the Terms of Service govern the use of the Platform offered by us, and you are giving the Company permission to use and store such information consistent with this Privacy Policy and the Terms of Service.

What information do we collect?

Personal Information. We collect Personal Information (i.e. data that allows someone to identify or contact you such as your name, address, geographic location of your computer or mobile device, telephone number, email address and Financial Information (as defined below) only if you voluntarily choose to share such information with the Company. However, in order for you to take advantage of particular Opportunities provided through the Platform, we may require that you furnish Personal Information.

When you register your account, sign up for newsletters, complete forms for optional programs, surveys, contests and other entries, and through communications transmitted through our Website, applications and your use of the mobile application, we collect information including your name, address, phone number and email address. We may also collect and record information about usage of the Website and Platform in order to better serve our Users and enhance our products and Services.

You also may choose to send the Company personally identifying information in an email message containing information or inquiries about the Platform.

Identity Verification. We may collect Personal Information, such as your date of birth, or taxpayer identification number, and address, to validate your identity or as may be required by law, such as to complete tax filings.

Financial Information. To help Users and Manufacturers setup a payment account and Users receive Merchandising Fees, we (or a third-party payment processor of our choosing and designation) may collect financial information, including name, address, credit card number, bank routing numbers, tax information, and any other payment information (“Financial Information”). If collected by us, we will use Financial Information solely as authorized by you in accordance with the Platform. To keep your financial data secure, we do not store full credit card information on our servers. We have contracted with a third party to process your payment card information.

Location Information. When you visit the Platform via a mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map to offer a better service for our Users. We will also be using such technology to verify your location when you are actively working an Opportunity. We will not share your current location with other Users. If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application; provided, however, that, any time you are working an Opportunity you must not turn off your location services.

Anonymous or Aggregated Data. We collect, store and may share certain data about the use of the Platform on an aggregate and/or anonymous basis. We do not link this information to anything personally identifiable to you if shared with third parties.

How do we use this information?

We may use your Contact Information and Personal Information to alert you of Opportunities, service your User Account, to communicate with you, to obtain your opinions on our Services, to send communications regarding our products and Services to Website visitors, and to alert you to new products and services. We may also use Contact Information, from time to time, to tell you about other promotional opportunities.

Will the Company share my information?

The Company does not rent or sell information about its customers or Users and we will only share your information under limited circumstances and always under strict controls against further disclosure. We will share your Contact Information and Personal Information with affiliated and unaffiliated third parties that perform services for us or for you, for example, third parties engaged in managing your User Account, completing money transfers and other transactions, vendors who assist us in offering related services, and others who assist us in sending communications to you. We require these third parties to keep your information confidential and we prohibit them from using your information for their own purposes.

We may invite you to participate in promotions and special offers offered directly by the Company or through specially selected third parties. Promotion materials will describe whether your participation in a promotion or offer will require us to gather and share your personal information with the sponsor or whether you will be asked to provide additional personal information directly to the sponsor. Participation in such programs is voluntary and such third parties are bound to maintain the confidentiality of, and not misuse, any personal information received from you or us.

In addition to the above, we may disclose Contact Information and Personal Information to unaffiliated third parties when one of the following circumstances exists:

· Where necessary for security purposes, to protect against fraud or unauthorized transactions, to resolve customer disputes or inquiries, or to respond to requests from persons who are acting in a fiduciary or representative capacity for you, or who hold a legal or beneficial interest in your account;

· To perform necessary credit checks or collect or report on debts owed to us; or

· As permitted by applicable law, including in response to legal process or requests from government authorities.

Finally, in the event that the Company or substantially all of its assets are acquired, customer information will be one of the transferred assets.

If you close your User Account with us, we will retain information about you and your account in an “inactive” status and we will continue to manage your Contact Information and Personal Information as described herein.

How does the Company use cookies?

“Cookies” are elements of data that a website can send to your browser and store on your computer. Our cookies do not collect or contain personal information about you or compromise the confidentiality of your Personal Information.

Our system may automatically gather information about the areas you visit on our Website or Platform and about the links you may select from within our site to other areas of the Internet or elsewhere online. We could use such information in the aggregate to understand how our users as a group use the services and resources provided on our sites. We may link such usage information to Contact Information or Personal Nonpublic Information in order to securely verify your identity, to personalize aspects of your experience on our Platform, to better understand which information or services are of greater value to our customers and users, and to send follow-up communications regarding our products and services to website visitors. We may share aggregated statistical information with our partners, suppliers and other third parties, but we will not share any individual names, personal navigational or other personal information.

The Platform uses cookies, tracking pixels and related technologies. Cookies may also be used to track how you use the Platform to target ads to you on other websites.

You can choose whether to accept cookies by changing the settings of your browser. You can reset your browser to refuse all cookies, or allow your browser to show you when a cookie is being sent. You can also erase cookies already stored on your computer. If you choose not to accept these cookies or if you erase them, your experience on our Platform, and other websites, may be diminished and some features may not work as intended.

What are my opt-out rights?

Because we do not share your information with affiliated or unaffiliated third parties for any purposes except as described above, such as helping us service your User Account and provide other services to the Company, you may not opt out of such sharing.

What are the Company’s standard security measures?

The Company takes the security of information very seriously and has established physical and electronic security standards and procedures to prevent unauthorized access to customer information. We use industry standard means such as physical, electronic and procedural safeguards, including, but not limited to data encryption and secure socket layer technology. We update and test our technology regularly to maintain and improve the protection of our customers’ information. We restrict access to personal information to employees and service providers for legitimate business purposes to assist in providing services to you. Employees who violate our privacy policy are subject to disciplinary action.

Notification of Changes

This Privacy Policy is periodically reviewed and enhanced by the Company as necessary. This Privacy Policy might change as the Company updates and expands the Platform. The Company will endeavor to notify you of any material changes by email, but will not be liable for any failure to do so. The Company also encourages you to review this Privacy Policy periodically. If you do not understand any of the terms or conditions of any of the Company’s policies, you may inquire regarding the same.
